March Cookie Battles, Full Rules

The “March Cookie Battles” sweepstakes (the “Sweepstakes”) is sponsored by Voortman Bakery (“Sponsor”). This Sweepstakes is governed by these official rules (“Official Rules”). By participating in the Sweepstakes, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Sweepstakes, as determined by Sponsor and its agents, are final in all respects. The Sweepstakes is subject to all federal, state, provincial and local laws and regulations and is void where prohibited by law.

This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. Any questions, comments or complaints regarding the promotion will be directed to Sponsor, not Facebook.

ELIGIBILITY
Sweepstakes open to legal residents of Canada (excluding Quebec) and the United States and/District of Colombia (excluding Arizona, Colorado, Maryland, Nebraska, North Dakota, and Puerto Rico), who have reached the age of majority in their province/territory/state of residence, all at the time of entry who have Internet access and a valid Facebook account prior to the beginning of the Sweepstakes Period. The Sweepstakes is subject to all applicable federal, provincial, state and local laws and void in Quebec, Arizona, Colorado, Maryland, Nebraska, North Dakota, Puerto Rico and where prohibited. Sponsor has the right to verify the eligibility of each entrant.

SWEEPSTAKES PERIOD
The Sweepstakes begins every Friday in the month of March 2018 at 9:00am Eastern Standard Time (EST) and ends every Sunday following at 9:00pm EST (“Sweepstakes Period”).

Individual Sweepstakes Periods are as follows (each a “Segment”):

Segment 1: Starts Friday, March 2 at 9:00am EST – ends Sunday, March 4^th at 9:00 ET
Segment 2: Starts Friday, March 9 at 9:00am EST – ends Sunday, March 11th at 9:00 pm ET
Segment 3: Starts Friday, March 16 at 9:00am EST – ends Sunday, March 18 at 9:00 ET
Segment 4: Starts Friday, March 23 at 9:00am EST – ends Sunday, March 25 at 9:00 ET
Segment 5: Starts Friday, March 30 at 9:00am EST – ends Sunday, April 1 at 9:00 ET

All entries (submissions) must be received on or before the time stated during each Segment. Sponsor reserves the right to extend or shorten the Sweepstakes at their sole discretion.

HOW TO ENTER
You can enter the Sweepstakes through the Sponsor Facebook page. During the Sweepstakes Period, Sponsor will post on its Facebook page (https://www.facebook.com/voortmancookies) a post related to the Sweepstakes (the “Sweepstakes Post”). Entrants must provide a relevant response by either using the Facebook LIKE or LOVE button to vote, to participate in the Sweepstakes. The response must remain on the Sweepstakes Post at the time of the winner selection to be eligible. For each completion of the relevant response submission that satisfies the Submission Requirement the entrant will receive one (1) entry into the drawing. Limit one (1) entry during each Segment.

WINNER SELECTION
All eligible entries received during a particular Segment will gathered into a database at the end of each Segment. At approximately 9:00am EST of the Monday following each Segment (with the exception of Segment 3), the Sponsor will randomly select one (1) potential winner from amongst the entries received on the highest voted response in the Sweepstakes Post. At approximately 9:00am EST of the Monday following Segment 3, the Sponsor will randomly select seventeen (17) potential winners from amongst the entries received for the highest voted response in the Sweepstakes Post. The winner(s) of each Segment, once verified, will be announced on Facebook at 1:00pm EST.  If a potential winner is a Canadian (excluding Quebec) resident, he/she must also correctly answer, unaided, a time-limited, mathematical skill-testing question to be administered via private message on Facebook. Each entrant is responsible for monitoring their Facebook private message for Grand Prize notification and receipt or other communications related to this Sweepstakes. If a potential Grand Prize winner cannot be reached by the Sponsor within fifteen (15) days, using the contact information provided at the time of entry, or if the Grand Prize is returned as undeliverable, or in the case of a Canadian Potential Grand Prize winner, failed to correctly answer, unaided, a time-limited, mathematical skill-testing question, that potential Grand Prize winner shall forfeit the prize. Upon the request of the Sponsor, the potential winner may be required to return an Affidavit of Eligibility, and a Release and Prize Acceptance Form, and in the case of a U.S. potential winner, a IRS W-9 form. If a potential winner fails to comply with these Official Rules, that potential winner will be disqualified. Grand Prizes may not be awarded if an insufficient number of eligible entries are received. The odds of winning a Grand Prize are solely dependent on the total number of eligible entries received during each Segment.

GRAND PRIZES
There are twenty-one (21) Grand Prize available to be won between Canada (excluding Quebec) and United States and the District of Colombia excluding Arizona, Colorado, Maryland, Nebraska, North Dakota, and Puerto Rico), each consisting of one (1) gift box containing five (5) packages of Voortman Cookies, as selected by the Sponsor (each a “Grand Prize”). Each Segment will have one (1) winner with the exception of the Segment 3, which will have seventeen (17) winners.

Cookies will be chosen at random by the Sponsor. All cookies will be shipped on or before April 10^th, 2018 to each individual winner. The maximum value of each Grand Prize is $32.00 Canadian. Sponsor will pay for shipping. No responsibility is assumed by the Sponsor for any postal mail or delivery return as undeliverable without a forwarding address. No responsibility is assumed by the Sponsor after it has been shipped.

Terms and conditions may apply. Incidental expenses and all other costs and expenses which are not specifically listed as part of a Grand Prize in these Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded Grand Prize are solely the responsibility of the respective Grand Prize winner. ANY TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY GRAND PRIZE IS SOLELY THE RESPONSIBILITY OF THE WINNER.

ADDITIONAL LIMITATIONS
The Grand Prize is non-transferable. No substitution or cash equivalent of Grand Prizes is permitted. Sponsor reserves the right, in its sole discretion, to substitute and/or modify any Grand Prize with (a) prize(s) of equal or greater value for any reason. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Sweepstakes, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any Grand Prize. Any attempt to damage the content or operation of this Sweepstakes is unlawful and subject to possible legal action by Sponsor. Sponsor reserves the right to terminate, suspend or amend the Sweepstakes, without notice, and for any reason, including, without limitation, if Sponsor determines that the Sweepstakes cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Sweepstakes. In the event any tampering or unauthorized intervention may have occurred, Sponsor reserves the right to void suspect entries at issue. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.

INDEMNIFICATION AND LIMITATION OF LIABILITY
BY ENTERING THE SWEEPSTAKES, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES, THE FACEBOOK PLATFORM, ADMINISTRATOR, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES AND THE ACCEPTANCE, USE OR MISUSE OF ANY GRAND PRIZE THAT MAY BE WON. SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE GRAND PRIZE. SPONSOR AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE SWEEPSTAKES.

PUBLICITY
By participating, each Grand Prize winner grants Sponsor permission to use his/her name, likeness or comments for publicity purposes without payment of additional consideration, except where prohibited by law.

LAW
Unless prohibited by law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and the Sponsor regarding the Sweepstakes shall be governed by the laws of the province of Ontario. All entrants consent to the jurisdiction and venue of the province of Ontario and agree that the Ontario courts shall have sole jurisdiction over any dispute or litigation arising from or relating to this Sweepstakes and hereby waive the jurisdiction of any other court that now or in the future could be considered competent for any reason. The venue shall only be within the province of Ontario.

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.  If any provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
